Terms of Use

1. Agreement

By downloading, accessing or using Afterglow, you agree to these Terms of Use and the Apple Standard End User Licence Agreement (the “Apple EULA”). If you do not agree, do not use the app. If these terms conflict with the Apple EULA, the Apple EULA controls to the extent of that conflict.

2. The service

Afterglow is a quotes and notes app for iPhone. It provides editorial quote content and lets you save quotes and write personal notes. Features may change, be improved, or be discontinued over time. Availability is not guaranteed to be uninterrupted or error-free.

3. Subscriptions and purchases

Afterglow may offer monthly or yearly auto-renewable subscriptions and a one-time lifetime purchase (“Premium”). The exact price and billing period are shown in the app before you confirm a purchase. Prices may vary by country and currency and may include applicable taxes.

• Payment is charged to your Apple Account when you confirm the purchase.
• An auto-renewable subscription renews automatically unless you cancel it at least 24 hours before the end of the current billing period.
• Your Apple Account is charged for renewal within 24 hours before the current period ends, at the price shown by Apple.
• You can manage or cancel subscriptions in your device’s Settings or App Store account settings. Deleting the app does not cancel a subscription.
• If a free trial or introductory offer is available, any unused portion may be forfeited when you purchase a subscription, where permitted.
• A lifetime purchase provides access to the Premium features offered for the supported lifetime of Afterglow; it is not a guarantee that the app or every feature will remain available forever.

Apple processes payments, cancellations and refunds. Refund requests are subject to Apple’s policies and applicable law. You can request a refund at reportaproblem.apple.com.

4. Premium access

Premium access is tied to the Apple Account used for the purchase and depends on a valid App Store entitlement. You may use Apple’s restore-purchases functionality where available. If a subscription expires, is cancelled, refunded or revoked, Premium features may become unavailable at the end of the applicable access period.

5. Your notes and acceptable use

You retain responsibility for the notes you create. You must not misuse Afterglow, attempt to interfere with its operation or security, reverse engineer it except where applicable law permits, use automated means to extract content, or use the app in violation of law or another person’s rights.

6. Quote content and intellectual property

Afterglow, its design, software, branding and curated presentation are protected by intellectual-property laws. Quotes and author attributions may belong to their respective authors, estates, publishers or other rightsholders. Your use of the app does not transfer ownership of this content or grant rights beyond personal use through Afterglow. Do not reproduce or commercially exploit content unless you have the necessary permission.

7. Sharing

Afterglow may let you share quote content using the iOS share sheet. You are responsible for what you share, where you share it, and ensuring that your use complies with applicable rights and the destination service’s rules.

8. Wellbeing disclaimer

Afterglow is intended for general reflection and inspiration. It does not provide medical, mental-health, legal, financial or other professional advice and is not a substitute for professional care. Do not rely on the app for emergency or critical decisions.

9. Third-party services

Afterglow relies on services provided by Apple and Google, including the App Store, StoreKit, iCloud, CloudKit and Firebase. Those services are governed by their providers’ terms and may affect Afterglow’s availability. The app may also link to third-party sites; Afterglow is not responsible for their content or practices.

10. Privacy

How Afterglow handles information is described in the Afterglow Privacy Policy.

11. Termination

You may stop using Afterglow at any time. Your right to use the app may end if you materially breach these terms or the Apple EULA. Provisions that by their nature should survive termination—including intellectual-property, disclaimer and liability provisions—will continue to apply.

12. Disclaimers and liability

To the fullest extent permitted by law, Afterglow is provided “as is” and “as available”. Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded, including applicable consumer rights. Liability is otherwise limited as set out in the Apple EULA and applicable law.

13. Changes

These terms may be updated to reflect changes to Afterglow, its subscriptions or legal requirements. The updated version will be published on this page with a revised effective date. Where required, material changes will be communicated through the app or another appropriate method.
